Trademark registration is the only legal good that works as before third parties who pretend to take possession of an identification or use signs that can be confused with yours. Argentinean Trademarks Law N° 22.362 allows you to register a denomination, logotype, isotype, slogan and everything related to identification. There is a classification which includes goods and services in different classes where the exclusivity is only obtained in the requested class/es. One trademark can be filed in the name of more than one person to distinguish goods and services. Also the registration can be in all the classes where deemed appropriate constituting a different certificate for each class. Before proceeding to the filing, it is recommend making a pre-filing search in order to check the viability, respecting of previous trademarks that could be an antecedent. After the filing, is obtained a filing number to establish priority before third parties. Then trademarks are published for one day in a bulletin edited by the trademark´s office where third parties have 30 days to file opposition. If there are no opposition, the expedient continue till the final registration where is granted for 10 years from that date.

Argentinean Patent Law N° 24.481 protects the new industrial products result of an inventive activity in order to find a solution of a technical problem as well as an improvement to something already existing. Than invention must be an absolute novelty and have industrial application. A patent is granted for 20 years from the filing date in the Argentine territory and it can not be renewed. In order to obtain a patent it is necessary an specification of the invention, drawings and claims. The documentation is file in the National Institute of Industrial Property (INPI) where automatically a serial number is assigned constituting a priority. After that, the INPI realize a formal examination where all the documentation is verified and later the patent is published for one day in a bulletin edited by the patent´s administration where third parties have 60 days to file opposition. Finally, the INPI realize a substantive examination, analyzing the invention and the possible antecedents. Once granted, annuities must be paid until the expiry date.
